By downloading, installing, or using LumibabyAI ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and LumibabyAI.
LumibabyAI is an AI-powered pregnancy companion application that provides the following features: ultrasound-to-AI photo transformation, 3D baby rendering, gender prediction (for entertainment only), future baby face generation, AI baby name suggestions, and a 40-week pregnancy album. The App is available on iOS devices and requires an internet connection for AI-powered features.
LumibabyAI is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment. All AI-generated content, including but not limited to gender predictions, baby face previews, and image transformations, are provided for entertainment and personal enjoyment purposes only.
Always consult qualified healthcare professionals (doctors, midwives, OB/GYNs) for any medical decisions related to your pregnancy. Never disregard professional medical advice or delay seeking it because of content you have seen in LumibabyAI.
You must be at least 18 years old to use LumibabyAI. By using the App, you represent that you meet this age requirement.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.
LumibabyAI offers both free and premium features. Premium features require an active subscription, which is billed through your Apple ID account.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period. You can manage and cancel subscriptions through your Apple ID account settings. No refunds are provided for partial subscription periods.
Where offered, free trials automatically convert to paid subscriptions at the end of the trial period unless cancelled beforehand.
When you upload ultrasound images or photos, you grant LumibabyAI a limited, non-exclusive license to process these images solely for the purpose of providing the App's features to you.
You agree not to upload content that is illegal, harmful, offensive, or violates the rights of others. You must have the right to use any images you upload.
AI-generated images and content produced by the App are provided for personal use only. You may share results on social media for personal, non-commercial purposes.
LumibabyAI and all associated content, features, and functionality are owned by us and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
You agree not to: reverse engineer, decompile, or disassemble the App; use the App for any commercial purpose without our written consent; attempt to gain unauthorized access to our systems; use the App in any way that could damage, disable, or impair our services; create derivative works based on the App; or violate any applicable local, state, national, or international law.
LumibabyAI integrates with third-party services including FAL.ai, OpenAI, Adapty, Firebase, and others. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.
You agree to indemnify, defend, and hold harmless LumibabyAI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.
We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice. Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination will survive.
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration.
We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or via email. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
